Paazee scam: CBI raids IG houses
CBI searched residences of Pramod Kumar, inspector general (armed police), at SAF village in Chennai and his native Bihar Monday in connection with the Rs 500-crore Tirupur Paazee scam and reportedly seized incriminating documents.
Paazee offered astronomical returns and reportedly collected more than Rs 500 crore from depositors in Coimbatore and Tirupur.
It not only failed to honour the promise but also gobbled up the investment. More than 10,000 investors approached police.
Pramod Kumar, west zone ex-IG, was in the middle of the scam that broke out two years ago. Police allegedly took crores to hush up the scam.
A deputy superintendent of police and inspector Mohan Raj were arrested. The inspector allegedly extorted nearly Rs 3 crore from Paazee MD Kamalavalli for not taking action. He claimed he shared the money with seniors.

Fearing arrest, IG seeks bail in 1,000-crore Paazee finance scam
CHENNAI: Pramod Kumar, inspector-general of police and senior IPS officer of Tamil Nadu cadre, has moved the Madras high court seekinganticipatory bail, apprehending arrest in the 1,000-crore Paazee finance scam. He is IG, armed police, here at present.

Justice M M Sundresh, before whom the matter came up for admission on Thursday, adjourned the case to March 27 for further hearing.

The Paazee Forex scam unfolded in the textile town of Tirupur in 2009. Three promoters - Kathiravan, K Mohanraj and Kamalavalli - had allegedly duped thousands of depositors of several hundred crores which were mobilized on the promise of huge interest rate. Pramod Kumar, who hails from Bihar and belongs to the 1989 batch, was inspector-general of west zone at that time.

After being transferred to the CB-CID in March 2010, the probe was later entrusted with the CBI by the high court on April 19, 2011. On March 12, 2012 Pramod Kumar's houses at Chennai as well as Bhagalpur in Bihar were searched by the central agency. Pramod Kumar also told the court that on March 13, 2012, he was interrogated by the CBI for seven years and that he had been intimated that he should attend further inquiry as and when called in future.

In his present petition, the IPS officer said that he was instrumental in transferring the case relating to the kidnap of Kamalavalli by some policemen to the CB-CID for impartial investigation.

Noting that she had enacted a drama to escape from culpability, he said he never handled the case in person, as it was the responsibility of district crime branch officials upto the rank of a deputy superintendent of police.

Pramod Kumar, pointing out that the two searches at his residences did not yield any evidence to link him to the scam, said even the Paazee promoters had not named him in their statements to the investigating officials as well as to the court.

Noting that a police officer creates a host of enemies and persons having grievances against him owing to the nature of his duty, the IPS officer said he could not be arrested merely on the statements of his subordinate officers, who are accused in the case.

IG seeks anticipatory bail in Pazee case

CHENNAI: Pramod Kumar (47) of SAF Games Village in Koyambedu, who faces charges for offences under various sections of the IPC and the TN Prohibition of Harassment to Women Act while working as the IGP in West Zone Coimbatore, has moved the Madras HC seeking anticipatory bail.
The charge against Pramod was that he received huge amounts from Paazee Forex Services in Tirupur, which swindled the deposits to the tune of several hundred crores from the investors, to protect its directors. His houses in Chennai and Bhagalpur in Bihar were searched by the CBI on March 12. A case had also been registered against him for offences under the Prevention of Corruption Act.Pramod contended that he did not have any link with the company or its directors. The firm had never stated that he demanded money or he was paid. No incriminating material was recovered in the searches at his houses in Chennai and Bihar. There was no allegation against him either from depositors or the accused company, Pramod added.

CBI charges IGP with abusing official position

CHENNAI: CBI today charged a police officer with abusing his official position when he was IG Police of West Zone, Coimbatore, and making his subordinates and accomplices extort Rs 2.85 crore, deposited by the public, from the Paazee Group of Companies.
The agency said investigation had revealed that Pramod Kumar, Inspector General of Police (Armed Police), had an active role in "orchestrating the extortion through his subordinate police officials and his accomplices."But for his involvement, the extortion of Rs 2.85 crore would not have been possible, CBI said in a counter filed in the Madras High Court in response to a plea for anticipatory bail by the officer who apprehended arrest for allegedly accepting graft from the investment firm.Opposing grant of bail, the CBI rejected the officer's claim that there was "no iota of any allegation or whisper" against him from the company or the depositors.The agency submitted that the investigation had revealed that the Directors of the Company were not only under obligation to repay the depositors but also under pressure to pay bribes to police officers during the relevant period.Stating that the investigation was at a crucial stage, the CBI said the main case of cheating the depositors was under active investigation.The probe had revealed that the officer had "prevailed upon his subordinate officers and junior officers in postings and transfers to meet the demand of bribe of Rs 10 crore from M/s Paazee Group of Companies on the assurance that they need not pay to the depositors." He needed to be interrogated further, CBI said and prayed for dismissal of anticipatory bail plea.Pramod Kumar was IGP, West Zone, between 2008 and 2010 during which time Tirupur district was under his jurisdiction.In his plea, the officer had submitted that neither the main persons involved in the case nor the directors of the firm had said that he had demanded any money or was given any money by them, when he was serving as IGP West Zone or to anyone on his behalf. This would go to show that he had no links with the directors, he said.

Paazee investors happy

Defrauded investors of Tirupur-based Paazee Forex Trading Company have at last seen light at the end of the tunnel following the arrest of one of the agents of the company from among the 27 persons referred by them to various investigating agencies.
“The arrest of Senthil Kumar, who figured in our list of 27 agents/benamis of the company, along with the former DSP (Tirupur sub-division) Rajendran by CBI from Coimbatore on Thursday, has given us hope that the investors will finally get justice and their money back,” Paazee Nidhi Niruvanathal Bathikkapattore Nala Sangham president N. Nachimuthu told The Hindu .
It was on Mr Natchimuthu's petition that the Madras High Court ordered CBI investigation into the alleged fraud committed by the Paazee group of companies after the petitioners expressed dissatisfaction with the investigation by the local police, the Central Crime Branch and the Economic Offences Wing.
Mr. Rajendran was among the few other officials whom the investors hit at the most for helping the directors of Paazee wriggle out of the scam.
Interestingly, Mr Rajendran, during a press meet at Tirupur had even ruled out the scam altogether.
Disappointment
However, the investors were disappointed that another agent of the company whom the investors caught from a hideout near Madurai a few days ago and handed to the local police there was reportedly let off by the police.
“We have now given a complaint to the IG (South Zone) of the police regarding the incident and the official had promised to constitute a special team to nab the agent again,” Mr. Natchimuthu said adding that the agent, Palanisamy, who managed to “escape” was the main benami of the Paazee directors.

Defrauded Paazee investors petition CM

Tirupur: Defrauded investors of Paazee Marketing and Paazee Forex Trading have submitted a memorandum to Chief Minister Jayalalithaa requesting the government to take steps to confiscate properties of the directors and the agents of the companies so that the investors would get their money back.
Paazee Nidhi Niruvanathal Bathikkapattore Nala Sangham president N. Nachimuthu told The Hindu that a list of 27 agents of the company and profiles of the directors had been furnished in the representation to the Chief Minister.
Acting on a petition of the Sangham the High Court had recently orderd a CBI investigation into the alleged swindle.
“The directors of the company, K. Kathiravan, K. Mohanraj and Kamalavalli, utilised the services of these agents to canvass and collect investments from the public,” Mr. Nachimuthu said.
According to him, almost Rs 1,600 crore of nearly 48,000 investors had been swindled by the company directors.

Tirupur: Defrauded investors in Paazee Marketing and Pazzee Forex Trading companies, on whose petition Madras High Court recently ordered a CBI inquiry into the alleged cheating, are to meet Chief Minister Jayalalithaa prior to CBI commencing its investigation in the case in the next few days.
In the meeting with the Chief Minister, the swindled investors would be seeking the assistance of the State machinery to arrest the agents deployed by the company to physically collect the money from customers at the earliest, which would be helpful for CBI investigation.
Police sources told The Hindu that CBI team would commence its investigation in the case within the next few days as it had obtained the court order.
The High Court had directed the CBI director to entrust the investigation to a competent officer.
The High Court order, pronounced by Justice C.T. Selvam on April 29, came on the petition moved by Paazee Nidhi Niruvanathal Bathikkapattore Nala Sangham, a welfare association comprising thousands of affected persons, and Loganathan of Namakkal district, which stated that the two companies lured the public to deposit their money by promising high returns only to cheat the investors subsequently.
“Almost 48,000 customers invested Rs. 1,600 crore and later found themselves in a predicament as post-dated cheques issued by the companies to the investors started getting bounced,” the sangham president N. Nachimuthu told The Hindu.
The two companies were run by K. Kathiravan, who worked as a reporter of a leading Tamil dailyin Tirupur for many decades, his son, K. Mohanraj, and Kamalavalli.
The investors approached the court only because they felt that officials of the Central Crime Branch and Economic Offences Wing had been colluding with the accused.
Already, three police officers including a Deputy Superintendent of Police and two Inspectors who had investigated the case were placed under suspension following allegations of corruption during the investigation.
Police officials' role
A senior police official told The Hindu that a few more police officials too were under scanner in the case based on intelligence reports filed by various agencies.
The CBI would investigate the role of these officials in relation to the transfer policies followed while posting the two accused Inspectors into the investigation process from some other localities, among other issues, the official pointed out.
It should be noted that an Inspector General of Police had already been interrogated by CB-CID at its headquarters in April for his alleged role in safeguarding the accused company directors.

HC order a relief for Paazee investors

Tirupur: For the many hundreds of defrauded depositors of Tirupur-based Paazee Marketing Company, the ordering of a CBI inquiry in the case by the Madras High Court on Tuesday had brought the much-needed relief.
“We have moved the court only after the various wings of the State police like the Economic Offences Wing and the Central Crime Branch failed to act impartially. Instead, they even colluded with the accused,” N. Suresh, vice-president of Paazee Nidhi Niruvanathal Bathikkapattore Nala Sangam (PNNBNS), told The Hindu.
The High Court pronounced the order based on a petition filed by PNNBNS, represented by its president N. Nachimuthu. The court had observed that the case had suffered a setback due to controversial dealings by a few police officials in Tirupur district for which criminal action had already been taken.
The petitioners pointed out that three proprietors of the firm – Kathiravan, a reporter of a leading Tamil daily posted at Tirupur, his son K. Mohanraj and Komalavalli, were running two companies Paazee Marketing company and Paazee Forex Trading India Private Limited and lured the public to deposit their money offering by promising exorbitantly high returns.
“However, they eventually cheated us,” Mr. Suresh said adding that around 48,000 depositors had been defrauded to the tune of Rs. 1,600 crore.

Court orders CBI enquiry into deposit fraud case

CHENNAI: The Madras High Court on Tuesday ordered a CBI enquiry into the alleged cheating of a large number of people who had deposited money to the tune of several crores of rupees in two companies in Tirupur.
Justice C.T. Selvam passed the order on petitions by the Paazee Nidhi Niruvanathal Bathikkapattore Nala Sangam (welfare association of affected persons) and one K. Loganathan of Namakkal district.
The Judge directed the CBI Director to take up investigation and entrust it to a competent officer. The State Government should provide necessary infrastructure to the central agency for conducting the investigation.
In its petition, the association, represented by its president, N. Nachimuthu, said K. Mohanraj, Kathiravan and Kamalavalli were running two companies – Paazee Marketing Company and Paazee Forex Trading India Private Limited. In the course of their business transaction, the three lured the public to deposit their money by promising high interest rates and attractive returns.
The three did not return the money invested by the public within the stipulated time. They issued post-dated cheques, which bounced. They also started evading payment of the principal. Nearly 48,000 persons had invested Rs.1600 crore, the petitioner said.
The affected persons had filed complaints with the police in 2009 and 2010. Initially, the three were granted anticipatory bail. Later, the relief was cancelled.
The Economic Offences Wing (EOW) of the State police and the Central Crime Branch, Tirupur, had not taken any action.
The petitioner prayed the court seeking a direction transferring investigation from the Tamil Nadu Police to CBI.
Following a court direction, the Deputy Superintendent of Police, EOW-II, Coimbatore, in an affidavit said special teams had been formed to trace the accused.
The Special Public Prosecutor for CBI cases, N. Chandrasekharan, opposed the plea to transfer the case to the central agency as the State police had almost completed investigations.

திருப்பூர் : பாசி நிதி நிறுவன பெண் அதிபரை கடத்தி, அவரிடம் இருந்து ஸீ2.95 கோடி பறித்ததாக டி.எஸ்.பி, இன்ஸ்பெக்டர்கள் உள்ளிட்டோர் மீது பதிவு செய்யப்பட்ட வழக்கு சிபிஐக்கு மாற்றப்படுகிறது. திருப்பூர், அவிநாசி சாலையில் செயல்பட்டு வந்த ‘பாசி போரெக்ஸ் டிரேடிங்‘ என்ற நிதி நிறுவனம், கோடிக்கணக்கான ரூபாய் மோசடி செய்ததாக தொடரப்பட்ட வழக்கை சி.பி.ஐ.க்கு மாற்ற வேண்டும் என நிதி நிறுவனத்தில் முதலீடு செய்தவர்கள் முறையிட்டனர்.

இதையடுத்து, இந்த வழக்கை சி.பி.ஐ.க்கு மாற்ற சென்னை உயர்நீதிமன்றம் உத்தரவிட்டது. இதேபோன்று, பாசி நிதி நிறுவனத்துக்கு ஆதரவாக செயல்பட்டதாக போலீசார் மீதும் புகார் எழுந்தது. இதுதொடர்பாக திருப்பூர் டி.எஸ்.பி ராஜேந்திரன், இன்ஸ்பெக்டர்கள் சண்முகையா, மோகன்ராஜ் ஆகிய 3 பேர் சஸ்பெண்ட் செய்யப்பட்டனர்.
இதற்கிடையே, 2009 டிசம்பர் 8ம் தேதி பாசி போரெக்ஸ் டிரேடிங் நிறுவன இயக்குனர் கமலவள்ளியை கடத்தி, ரூ.2.95 கோடி பணம் பறித்ததாக புகார் கூறப்பட்டது. இதுதொடர்பாக அவிநாசி நீதிமன்றத்தில் ஆஜராகி நிதி நிறுவன இயக்குனர் கமலவள்ளி, நீதிபதி முன்பு ரகசிய வாக்குமூலம் அளித்தார்.

அதன்படி, இந்த வழக்கு, சிபிசிஐடி வசம் ஒப்படைக்கப்பட்டது. விசாரணையில், பணம் பறித்தது உறுதி செய்யப்பட்டதை அடுத்து, வழக்கில் குற்றம் சாட்டப்பட்ட இன்ஸ்பெக்டர் மோகன்ராஜை, சிபிசிஐடி போலீசார் கைது செய்தனர். இன்ஸ்பெக்டர் சண்முகையா முன்ஜாமீன் பெற்றார். சில உயரதிகாரிகளிடமும் விசாரணை மேற் கொள்ளப்பட்டது.

வழக்கை விசாரித்த சிபிசிஐடி டி.எஸ்.பி மலைச்சாமியிடம் கேட்டபோது, ‘‘பாசி நிதி நிறுவன மோசடி வழக்கை சி.பி.ஐ.க்கு மாற்றி உயர்நீதிமன்றம் உத்தரவிட்டது. போலீஸ் அதிகாரிகள் மீதான இந்த பணம் பறிப்பு வழக்கும் அதோடு தொடர்புடையது என்பதால், இந்த வழக்கையும் மாற்ற வேண்டும் என சி.பி.ஐ. கோரியது. அதன்படி இந்த வழக்கு மாற்றப்பட உள்ளது. இதுதொடர்பான ஆணை கிடைத்தவுடன் சி.பி.ஐ. வசம் ஒப்படைக்கப்படும்’’ என்றனர்.

Tirupur DSP suspended

TIRUPUR: The district police confirmed the suspension of Deputy Superintendent of Police N Rajendran from service on Sunday for his alleged involvement in extortion of money from a woman.
According to police sources, Rajendran and a former inspector of Central Crime Branch in Tirupur V Mohanraj forced a woman director of Paazee Private Trading Company to pay them a bribe in return for not taking action against her.
The Paazee Private Trading Company is said to have collected hundreds of crores from gullible investors by assuring them to return double their deposits within a year.
As thousands of investors demanded their money back, the case was transferred to the Economic Offences Wing, Coimbatore, for further investigation.
Meanwhile, police here had registered a case recently based on a complaint filed by the woman director of the firm.
As the primary investigations revealed that the allegations of extortion were true, DSP Rajendran, who has been shifted to the Ooty rural division, proceeded on medical leave, the sources said.
However, the ADGP suspended him on Sunday pending enquiry, while inspector Mohanraj has already been suspended from service, the police sources added.

சென்னை:கோடிக்கணக்கில் மோசடி செய்ததாக "பாசி' நிறுவனத்தின் மீது தொடரப்பட்ட வழக்கை, சி.பி..,க்கு மாற்றக் கோரி, சென்னை ஐகோர்ட்டில் மனு தாக்கல் செய்யப்பட்டுள்ளது. அறிக்கை தாக்கல் செய்ய போலீசாருக்கு உத்தரவிடப்பட்டுள்ளது.நாமக்கல் மாவட்டம், பரமத்திவேலூர் அருகில் உள்ள வேலூர் பகுதியைச் சேர்ந்த வக்கீல் லோகநாதன் தாக்கல் செய்த மனு:திருப்பூரில் இயங்கி வந்த "பாசி' நிறுவனத்தில் 45 லட்சம் ரூபாய் டிபாசிட் செய்தேன். எனது உறவினர்கள், நண்பர்கள் ஒரு கோடிக்கும் மேல் டிபாசிட் செய்தனர்.

இந்த நிலையில் பாசி நிதி நிறுவன அதிபர்கள் கதிரவன் (68), மோகன்ராஜ் (29), கமலவள்ளி ஆகியோர் தங்களை கைது செய்யாமல் இருக்க ஐகோர்ட்டில் முன் ஜாமீன் கேட்டு மனு செய்து இருந்தனர். இவர்களின் முன்ஜாமீன் மனுக்களை விசாரித்த நீதிபதி கே.என்.பாஷா மனுவை தள்ளுபடி செய்து தீர்ப்பளித்தார்.
இந் நிதி நிறுவன மோசடி குறித்து சி.பி.ஐ. விசாரணை கோரி பாதிக்கப்பட்ட முதலீட்டாளர் லோகநாதன் என்பவர் ஐகோர்ட்டில் தாக்கல் செய்த மனுவுக்கு 1 வாரத்தில் பதில் அளிக்கும் படி பொருளாதார குற்றப்பிரிவு போலீசாருக்கு நோட்டீஸ் அனுப்ப நீதிபதி அக்பர் அலி உத்தரவிட்டார்.
திருப்பூரைச் சேர்ந்த இந் நிதிநிறுவனம் தமிழகமெங்கும் கிளைகளைக் அமைத்து ரூ.800 கோடி வசூலித்து திருப்பிக் கொடுக்காமல் மோசடி செய்ததாக 10 ஆயிரத்துக்கும் மேற்பட்ட முதலீட்டாளர்கள் பொருளாதார குற்றப்பிரிவு போலீசில் புகார் கொடுத்துள்ளனர்.

இந்நிலையில், மீண்டும் முன்ஜாமீன் கோரி, மூவரும் மனுக்கள் தாக்கல் செய்தனர். இவர்களுக்கு முன்ஜாமீன் வழங்க எதிர்ப்பு தெரிவித்து, நாமக்கல் மாவட்டத்தைச் சேர்ந்த வக்கீல் லோகநாதன் மனுதாக்கல் செய்தார்.மூன்று பேர் சார்பில் ஆஜரான வக்கீல், "சிங்கப்பூரில் உள்ள வங்கியில் பணம் உள்ளதால், அவ்வப்போது பணத்தை திருப்பிச் செலுத்த, மனுதாரர்கள் தயாராக உள்ளனர். ஆனால், அந்த வங்கிக் கணக்கு முடக்கி வைக்கப்பட்டுள்ளது. அதனால், அங்கிருந்து பணத்தை இங்குள்ள கணக்குக்கு மாற்ற முடியவில்லை. வேண்டுமென்றே நிபந்தனைகளை மனுதாரர்கள் மீறவில்லை."சில டிபாசிட்தாரர்களுக்கு பணம் கொடுக்கப்பட்டுள்ளது. 419 கோடி ரூபாய் இவ்வாறு திருப்பி செலுத்தப்பட்டுள்ளது. முன்ஜாமீன் வழங்கினால், டிபாசிட்தாரர்களுக்கு பணம் கொடுக்க மனுதாரர்கள் எல்லா முயற்சிகளையும் எடுப்பர்' என்றார்.


அரசு வக்கீல் ஏ.சரவணன், "கோர்ட் விதித்த நிபந்தனைகளை பின்பற்றாததால், முன்ஜாமீன் ரத்து செய்யப்பட்டுள்ளது. இவர்களது மனுவை சுப்ரீம் கோர்ட்டும் தள்ளுபடி செய்துள்ளது. புலன்விசாரணை முக்கிய கட்டத்தில் உள்ளது. மனுதாரர்கள் தலைமறைவாக உள்ளனர். அவர்களுக்கு முன்ஜாமீன் வழங்கக் கூடாது' என்றார்.மனுக்களை விசாரித்த நீதிபதி பாஷா பிறப்பித்த உத்தரவு:இது ஒரு துரதிர்ஷ்டவசமான வழக்கு. நடுத்தர வர்க்கத்தைச் சேர்ந்த ஆயிரக்கணக்கான பேர், அதிக வட்டி கிடைக்கும் என கருதி, பணத்தை டிபாசிட் செய்துள்ளனர். கடைசியில் மோசடி செய்யப்பட்டுள்ளனர். கோடிக்கணக்கான ரூபாய் மோசடி செய்யப்பட்டுள்ளது.


எவ்வளவு பணம் மோசடி செய்யப்பட்டது என, போலீசாரால் இன்னும் நிர்ணயிக்க முடியவில்லை. முன்ஜாமீன் வழங்கியும், டிபாசிட்தாரர்களுக்கு இன்னும் பணம் கொடுக்க முடியவில்லை.கோர்ட் விதித்த நிபந்தனைகளை பூர்த்தி செய்யவில்லை. எனவே, முன்ஜாமீன் ரத்து செய்யப்பட்டுள்ளது. சுப்ரீம் கோர்ட்டும் இவர்களின் மனுக்களை தள்ளுபடி செய்துள்ளது. பணம் மோசடி செய்பவர்களை இரும்புக் கரம் கொண்டு அடக்க வேண்டும். இல்லையென்றால், பாதிக்கப்பட்டவர்களுக்கு மனஉளைச்சல், சித்ரவதை என ஈடுசெய்ய முடியாத இழப்பு ஏற்படும். மனுக்கள் தள்ளுபடி செய்யப்படுகிறது.இவ்வாறு நீதிபதி பாஷா உத்தரவிட்டுள்ளார்.

HC denies bail to Paazee promoters

CHENNAI: Over two years after the multi-crorePaazee finance scam, involving the deposits of over 40,000 people, surfaced, the Madras high court has described it as an unfortunate' case and denied anticipatory bail to its promoters. 

"Money-grabbers have to be dealt with with an iron hand, otherwise, the affected persons would be put to great hardship and irreparable loss and they would be subjected to mental agony and torture," saidJustice KN Basha on Friday. He made the observations while dismissing the anticipatory bail pleas of three of the Paazee group directors, K Mohanraj, K Kathiravan and A Kamalavalli. 

The Paazee group, based in Tirupur, floated at least 10 companies engaged in insurance, marketing and investments. Said to have been registered in three countries, including Singapore, the company accepted deposits from about 40,000 people, promising attractive returns and interest rates. One scheme promised triple the deposit amount within a period of three months. Ever since the scam came to light, complaints have been pouring in from various states. 

Though anticipatory bail was granted to its directors in October 2009 after they promised to deposit Rs 1 crore every week, the directors failed to honour the voluntary undertaking. They had also claimed that a sum of Rs 98 crore was lying in a HSBC Bank account in Singapore, and that they could bring the money to India only if allowed to go on bail. The anticipatory bail, however, was cancelled by the high court, after the depositors refused to comply with court's conditions. The Supreme Court also dismissed a special leave petition against the rejection of anticipatory bail in September 2010. 

On Friday, Justice KN Basha, dismissing the latest pleas of the Paazee directors, observed: "This is a very unfortunate case, wherein thousands and thousands of middle income group people have been lured and induced to part with their hard-earned money under the guise of returning the same with lucrative interest. Ultimately they have been cheated by the petitioners (company directors). It is pertinent to note that the amount said to have been cheated by the petitioners runs to several crores and even the investigating agency is not able to fix the exact amount as the complaints are pouring everyday. It is also very unfortunate to note that in spite of granting the interim relief of anticipatory bail by this court, the petitioners have not settled the amounts to the depositors". 

A depositor, K Elangovan, has filed a separate petition to hand over investigation to the CBI, as the matter involved several states and countries, where the state police's economic offences wing cannot go and probe. Justice GM Akbar Ali has asked the state authorities to submit reply within a week.

CHENNAI: Money-grabbers should be dealt with an iron hand. Otherwise, the affected persons will be put to great hardship, suffer irreparable loss and subjected to mental agony and torture, the Madras High Court has said.
Justice K.N. Basha made the observation while dismissing anticipatory bail petitions of three directors of Paazee, a Tirupur-based company.
The police had registered a case for an alleged offence punishable under Sections 3 and 4 of The Prize Chits and Money Circulation Scheme (Banning) Act and Section 420 of IPC (cheating). The petitions were filed by K. Mohanraj, K. Kathiravan and A. Kamalavalli.
Mr. Justice Basha observed: “This is a very unfortunate case wherein thousands of middle income group people have been lured and induced to part with their hard-earned money under the guise of returning the same with lucrative interest, and ultimately cheated by petitioners.”
They have been cheated to the tune of several crores of rupees.
The investigating agency was not able to fix the exact amount as complaints poured in every day.
Despite grant of anticipatory bail earlier by the High Court (which was subsequently cancelled on grounds of non-compliance with conditions imposed), the petitioners had not settled the amounts to the depositors. During the course of hearing of applications for cancellation of advance bail, the petitioners had voluntarily undertaken to deposit Rs.1 crore every week and they had filed affidavit. Even that undertaking was not complied with.
Mr. Justice Basha said he was of the considered view that the petitioners were not entitled to anticipatory bail.

Advance bail plea rejected

 
CHENNAI: The Madras High Court has refused advance bail to K Mohanraj, K Kathiravan and A Kamalavalli, directors of PAAZEE of Tirupur, who apprehended arrest for cheating the depositors to the tune of several hundred crores of rupees.
``The money-grabbers have to be dealt with an iron hand, otherwise, the affected persons would be put into great hardship and irreparable loss and they would be subjected to mental agony and torture,’’ Justice KN Basha observed on Friday.The judge was dismissing the advance bail applictions from the trio. Originally, by an order dated October 8, 2009, the High Court had granted advance bail. As the bail conditions were not complied with, the High Court cancelled the relief.Aggrieved, the trio moved the Supreme Court, which on September 21, last year, dismissed their petition. Hence, the present applications seeking the same relief. K Loganathan of Vettukattu Pudur in Namakkal district andothers filed petitions opposing the relief prayed for.And accepting the arguments of government advocate (criminal side) A Saravanan and impleding petitioner’s counsel MS Senthil Kumar, the judge rejected the plea of the trio.
